I.          Preliminary Matters:

General Statute § 138A-15 mandates that the Chair inquire as to whether any member knows of any known conflict of interest or appearance of conflict with respect to matters before the Commission.  If any member knows of a conflict of interest or appearance of a conflict, please so state at this time.

2.        Approval of minutes from the Air Quality Committee meeting on July 10, 2019. 

II.        Concepts:

1.   Session Law 2013-413 (H74) Readoption of Group 6 Air Quality Rules 15A NCAC 02D .0403, .0500, .0900, .1400, .1700 and .2615 (549)

Explanation:  The Division of Air Quality requests approval of the hearing officer’s report and final approval of the regulatory impact analysis for the proposed readoption of rules 15A NCAC 02D .0600-.0615, .2100-.2104, .2300-.2311 and .2600-2621 pursuant to Session Law 2013-413 (H74).

Recommendation:  The Hearing Officer recommends that the proposed readoption of 15A NCAC 02D .0600, .2100, .2300, and .2600, with the recommended changes by the commenters and the hearing officer, as presented in Chapter II, and the final regulatory impact analysis in Chapter VI of the hearing report be adopted by the Environmental Management Commission.

The Hearing Officer also recommends, with DAQ support, to defer action on 15A NCAC 02D .2615 by removing the rule from the Group 5 readoption package and including it with the Group 6 readoption package.
