NOTIFICATION OF INTENT TO ISSUE A CONSENT ORDER

 

Public notice of intent to issue a State Consent Order to the following:

Duke Energy Carolinas, LLC (526 S. Church Street; Charlotte, NC 28202) has requested Special Order by Consent WQ S16-005 for its Riverbend Steam Station Wastewater Treatment Plant (WWTP), that discharges treated wastewater to the Catawba River (Mountain Island Lake) in the Catawba River Basin under the authority of NPDES Permit NC0004961, but is unable to consistently comply with effluent limits for pH and Total Hardness at outfalls 101 – 112 (discharges from seeps).
 

The Environmental Management Commission proposes to issue the Order per Article 21 of Chapter 143, N.C. General Statutes, and other regulations effective November 3, 2016.

Compliance with this Order requires completion of surface impoundment (coal ash basin) closure activities at the Riverbend Steam Station such that discharges from seeps are eliminated, or become compliant with effluent limits established by NPDES permit NC0004961. Duke Energy Carolinas, LLC shall comply with NPDES permit limits with the exception of the interim effluent limitations identified in the Order.  This Order will expire on September 1, 2020.
