NOTIFICATION OF INTENT TO ISSUE A CONSENT ORDER

Public notice of intent to issue a State Consent Order to the following:

Badin Business Park LLC (P. O. Box 576, Badin, NC 28009) has requested Special Order by Consent EMC SOC WQ S18-010 for its Badin Business Park facility that discharges groundwater, stormwater, and fire protection water to Little Mountain Creek in the Yadkin-Pee Dee River Basin under the authority of NPDES Permit NC0004308 but is unable to consistently comply with effluent limits for total fluoride and total cyanide.

The Environmental Management Commission proposes to issue the amended Order per Article 21 of Chapter 143, N.C. General Statutes, and other regulations effective June 1, 2019.

Compliance with this order will require the Badin Business Park LLC to complete the design, prepare the specification package, and complete the construction for the Badin Business Park piping system upgrade to attain compliance with the final effluent limitations in the NPDES Permit. Badin Business Park LLC shall comply with NPDES permit limits with the exception of the interim effluent limitations identified in the Order. This Order will expire on October 31, 2019.

Comments on the proposed amended Order received no later than June 7, 2019 will be considered in the final determination. A public meeting may be held if there is a significant degree of public interest.
