IMPORTANT ILF MITIGATION PROCEDURES IN RESPONSE TO COVID-19

Based on current guidance to minimize the spread of COVID-19, the Green Square office has been closed to public access. During this period, all In-Lieu Fee mitigation request procedures will continue to be carried out electronically. All in-person appointments are suspended until further notice. Customers may submit their Mitigation Request forms, Bank Law Compliance Forms, and/or permits electronically via email. The Division of Mitigation Services will respond to customer requests (acceptance letters, invoices, receipts) electronically via email. Customers can pay invoices electronically on the DMS website or by mailing their check to the NC Division of Mitigation Services. Note: Mail services may be limited during this time and mail delivery and response times for processing checks may take up to 1 to 2 weeks to process.

What We Do

The Division of Mitigation Services (DMS) is a state Department of Environmental Quality initiative that restores and protects wetlands and waterways for future generations while offsetting unavoidable environmental damage from economic development. DMS offers four In-Lieu Fee mitigation programs designed to assist private and public developers in meeting state and federal compensatory mitigation requirements for streams, wetlands, riparian buffers, and nutrients. DMS utilizes receipts from these programs to restore streams, wetlands, and forested buffers by working with state and local partners, including willing landowners to concentrate mitigation resources in areas where they will have the greatest watershed benefit. The NC Department of Transportation and other entities voluntarily elect to use DMS to move their development projects forward in a timely and affordable manner.
