NOTIFICATION OF INTENT TO ISSUE A CONSENT ORDER
This is a Public Notice of intent to issue an amended State Consent Order to the following:

The Town of Burnsville (P.O. Box 87, Burnsville, NC  28714-0087) has requested an amendment to existing Special Order by Consent S21-003 for its wastewater treatment facility under the authority of discharge permit NC0020290.  The Burnsville WWTP discharges treated domestic wastewater to the Cane River in the French Broad River Basin.

The Environmental Management Commission proposes to issue the amended Order per Article 21 of Chapter 143, N.C. General Statutes, and other regulations effective August 1, 2024.

Compliance with this amended Order requires the adjustment of completion dates for construction of improvements to the current WWTP, which include:
Complete overhaul and rehabilitation of the 0.5 MGD treatment train at the Burnsville WWTP.
Completion of the project will provide the Town with the ability to adequately treat incoming wastewater, properly manage solids and aid the facility in returning to compliance with its NPDES permit.

Funding has been secured by Burnsville for the necessary construction activities.  Burnsville shall comply with its existing NPDES permit limits.  This Order will expire on March 31, 2027.
