I. Preliminary Matters
1. Call to Order and Notice of NCGS §138A-15 (Chairman Puette)
General Statute §138A-15 mandates that the Chairman inquires as to whether any member knows of any known conflict of interest or appearance of conflict with respect to matters before the Environmental Management Commission’s Groundwater and Waste Management Committee. If any member knows of a conflict of interest or appearance of conflict, please so state at this time.
Approval of minutes from Groundwater and Waste Management Committee (GWWMC) meeting on July 11, 2018. (attached).
II. Action Items
1. Request Approval to Proceed to the EMC for Public Comment and Hearing on 15A NCAC 02L Section .0400 “Risk-Based Assessment and Corrective Action for Petroleum Underground Storage Tanks” and Section .0500 “Risk-Based Assessment and Corrective Action for Petroleum Releases From Aboveground Storage Tanks and Sources.” (Scott Bullock, DWM - UST)
Explanation: The Division of Waste Management Underground Storage Tank Section is requesting approval to proceed to the Environmental Management Commission in November 2018 for approval of the Regulatory Impact Analysis and to proceed to public comment and hearing on periodic rule readoption and amendments for 15A NCAC 02L Section .0400 “Risk-Based Assessment and Corrective Action for Petroleum Underground Storage Tanks” and Section .0500 “Risk-Based Assessment and Corrective Action for Petroleum Releases From Aboveground Storage Tanks and Sources.” The rules are proposed for readoption pursuant to G.S. 150B-21.3A.
Recommendation: That the GWWMC approve the proposed amendments and readoption of rules in 15A NCAC 02L Section .0400 Risk-Based Assessment and Corrective Action for Petroleum Underground Storage Tanks and Section .0500 Risk-Based Assessment and Corrective Action for Petroleum Releases from Aboveground Storage Tanks and Sources to proceed to the EMC meeting in November 2018 for public comment and hearing.

III. Information Item
1. Update on Rule Readoption Timeline for 15A NCAC 02L – Groundwater Classification and Standards (Jennifer Everett, DEQ Office of General Counsel)
Explanation: The Division of Water Resources and Waste Management are providing an update on the proposed readoption deadline for 15A NCAC 02L –“Groundwater Classification and Standards.” Pursuant to G.S. 150B-21.3A, the Rules Review Commission approved the Periodic Review of Existing Rules Report for 15A NCAC 02L at its February 15, 2018 meeting and the report became effective on March 6, 2018
