I.  Preliminary Matters

1. Call to Order and Notice of NCGS § 138A-15 ……...…………………………………......Chairman Martin 

General Statute § 138A-15 mandates that the Chairman inquire as to whether any member knows of any known conflict of interest or appearance of conflict with respect to matters before theEMC Groundwater Committee. If so, please state at this time. 

2. Approval of minutes from July 9, 2014 (attached) 

II. Information Items: 

1. Status of rules review of 15A NCAC 02S in accordance with S.L. 2013-413 (HB74) (Pete Doorn, DWM)

In accordance with General Statute 150B-21.3A, the EMC at its July 2014 meeting made an initial determination of “necessary with substantive public comment” for 12 of the 16 rules in Subchapter 02S, and a determination of “necessary without substantive public interest” for four of the 16 02S rules. A public comment period was held from July 11, 2014 through September 17, 2014, on the initial determinations of these rules. No comments were received during the comment period. Staff will return to the EMC in January 2015, with a request for final action on the 02S Rule Review report.

2. DENR study on the use of contaminated property (Linda Culpepper, DWM) 

DENR is directed by SL 2014-120 to study ways to improve the timeliness of actions necessary to address contaminated properties such that the property is safe for productive use, threats to the environment and public health are minimized to acceptable levels, and the risk of taxpayer-funded remediation is reduced. A report of the study results is due to the Environmental Review Commission by November 1, 2014. A summary will be provided.
