NOTIFICATION OF INTENT TO ISSUE A CONSENT ORDER
Public notice of intent to issue a State Consent Order to the following:
The City of Dunn (P. O. Box 1065, Dunn, NC 28335) has requested Special Order by Consent EMC SOC WQ S17-002 for its Wastewater Treatment Plant, which has a permitted discharge of 3.75 MGD treated wastewater to Cape Fear River in the Cape Fear River Basin under the authority of NPDES Permit NC0043176. The City also holds collection system permit WQCS00073. The City has had persistent issues with inflow and infiltration within this system which contribute to violations at the WWTP as well as Sanitary Sewer Overflows.
The Environmental Management Commission proposes to issue the Order per Article 21 of Chapter 143, N.C. General Statutes, and other regulations effective June 1, 2022.
Compliance with this order will require the City of Dunn to begin and complete construction for upgrades, repairs, and rehabilitation of their collection system and wastewater treatment plant, to attain compliance with the requirements of their permits. This Order will expire on March 31, 2027.

Comments on the proposed Order received no later than June 26, 2022 will be considered in the final determination. A public meeting may be held if there is a significant degree of public interest.
