SPECIAL ORDER BY CONSENT FOR

PCS PHOSPHATE COMPANY, INC.

AURORA, BEAUFORT COUNTY

PCS Phosphate Company, Inc. – Aurora (the Company) operates a phosphoric acid plant which includes six phosphate rock calciners in Beaufort County, North Carolina.  The facility is located at 1530 NC Highway 306 South, Aurora, NC 27806.  The Company has agreed to a Special Order by Consent (SOC) with the North Carolina Division of Air Quality (DAQ) for violations of 40 CFR Part 63, Subpart AA - National Emission Standards for Hazardous Air Pollutants From Phosphoric Acid Manufacturing Plants.  The terms of the SOC run through 2021 and require material sampling and analysis, air emissions testing, emissions reporting, stipulated penalties for failing to meet milestones, and a feasibility report for subsequent action to reduce or control emissions.

Interested persons are invited to review the proposed SOC, and to submit written comments to the DAQ at the above address, so that the comments are received by November 23, 2016. Any person requesting a public meeting regarding the proposed SOC should submit a written request with a statement supporting the need for such a meeting. The request should be sent to the DAQ at the above address, so that the request is received by November 23, 2016.  The DAQ Director shall take final action for the Commission on Consent Orders within 60 days of the initial public notice.
