NOTIFICATION OF INTENT TO ISSUE AN AMENDED CONSENT ORDER
Public notice of intent to issue an amendment to a State Consent Order to the following:
The County of Chowan (P.O. Box 1030, Edenton, NC 27932) has requested Special Order by Consent EMC SOC WQ S16-003 Ad III for the Valhalla WTP, an existing wastewater treatment works that discharges treated wastewater to Pollock Swamp, Class C-NSW waters of this State in the Chowan River Basin under the authority of NPDES Permit NC0032719. However, the County is not discharging into the said outlet in accordance with NPDES Permit NC0032719, but instead discharging into a settling basin which allow the treated wastewater to infiltrate into groundwater of the State. The County has exceeded groundwater standards at the compliance boundary of Chloride, Iron, and Manganese.
The Environmental Management Commission proposes to issue the amended Order per Article 21 of Chapter 143, N.C. General Statutes, and other regulations effective December 1, 2022.
Compliance with this amended order will require the County to prepare plans and specifications for construction and operation of additional treatment works as well as an alternative means of disposal. This amended Order will expire on May 31, 2031.

Comments on the proposed amended Order received no later than 30 days after the publish date of this notice will be considered in the final determination.
