NOTIFICATION OF INTENT TO ISSUE A CONSENT ORDER
This is a Public Notice of intent to issue a State Consent Order to the following:
The Town of Burnsville (P.O. Box 97, Burnsville, NC 28714) has requested Special Order by Consent S21-003 for its wastewater treatment facility under the authority of discharge permit NC0020290. The Burnsville WWTP discharges treated domestic wastewater to the Cane River in the French Broad River Basin. The Environmental Management Commission proposes to issue the Order per Article 21 of Chapter 143, N.C. General Statutes, and other regulations effective February 1, 2022. Compliance with this Order requires the planning, design and construction of improvements to the current WWTP, which include: Upgrade of multiple pump stations, including a connection to the East Yancey collection system; a GIS mapping project to identify all stormwater sewers and reduce Inflow & Infiltration (I&I) to the wastewater collection system; complete overhaul and rehabilitation of the 0.5 MGD treatment train at the Burnsville WWTP. Completion of the project will provide the Town with the ability to adequately treat incoming wastewater, properly manage solids and aid the facility in returning to compliance with its NPDES permit. Funding has been secured by Burnsville for the necessary construction activities. Burnsville shall comply with its existing NPDES permit limits. This Order will expire on March 30, 2025. Comments on the proposed Order received no later than January 15, 2022 will be considered in the final determination. A public meeting may be held if there is a significant degree of public interest.
