NOTIFICATION OF INTENT TO ISSUE A CONSENT ORDER
Public notice of intent to issue a State Consent Order to the following:
The Town of Mount Olive (P. O. Box 939, Mount Olive, NC 28365) has requested Special Order by Consent EMC SOC WQ S20-0021 for its Wastewater Treatment Plant, a 2.0 MGD WWTP with a permitted discharge of 1.0 MGD treated wastewater to Northeast Cape Fear River in the Cape Fear River Basin under the authority of NPDES Permit NC0020575 with additional wastewater to be disposed of pursuant to the terms of WQ0029169. The Town is unable to consistently comply with permitted effluent limits for Flow.

The Environmental Management Commission proposes to issue the Order per Article 21 of Chapter 143, N.C. General Statutes, and other regulations effective December 1, 2022.

Compliance with this order will require the Town of Mount Olive to begin and complete construction for upgrades including repairs of the non-discharge irrigation system, WWTP repairs, and collection system repairs, to attain compliance with final effluent limitations in the NPDES Permit. The Town of Mount Olive shall comply with NPDES permit limits with the exception of the interim effluent limitations identified in the Order. This Order will expire on May 31, 2026.

Comments on the proposed Order received no later than December 20, 2021 will be considered in the final determination. A public meeting may be held if there is a significant degree of public interest.
