Public Comment Period for Title V Rule Revisions

Purpose: To receive comments on the proposed amendments to the Title V Rules in 15A NCAC 02Q .0103 and .0500. Also, to receive comment on the accompanying regulatory impact analysis for the proposed amendments.

On August 31, 2001, the North Carolina Division of Air Quality (DAQ) obtained Environmental Protection Agency (EPA) approval of its Title V operating permit program. EPA conducted reviews of North Carolina’s Title V program in 2005, 2010, and 2014. As part of the fourth program review, which was initiated in 2020, EPA provided DAQ with comments on the Title V Rules in Subchapter 02Q. To address these comments and provide clarity and consistency throughout the rules, DAQ is proposing to revise the Title V rules in 15A NCAC 02Q .0103 and .0500

On November 18, 2021, the Environmental Management Commission (EMC) approved proceeding to public comment on the proposed Title V rule revisions.

15A NCAC 02Q .0103 and .0500 are proposed for amendment to address comments received from EPA during the fourth program review of North Carolina’s Title V program.
