Public Hearing on proposed revisions to sedimentation control rules 15A NCAC 04 on Aug. 1

The N.C. Department of Environmental Quality’s Division of Energy, Mineral and Land Resources (DEMLR) and the Sedimentation Control Commission will host a public hearing on Thursday, August 1, to receive public comments and review the rules codified in 15A NCAC 04.

Session Law 2013-413 (House Bill 74) requires a periodic review of all rules used by state agencies. Most of the proposed rule changes are administrative in nature and add clarity to the rules. The proposed rule changes can be found at https://deq.nc.gov/permits-regulations/rules-regulations/proposed-rules.
 
In addition to the proposed changes, the Sedimentation Control Commission is requesting comments on: Rule 04A .0105(29), regarding ‘bank full flows’, Rule 04B .0107. regarding permanent ground cover considerations for restraining erosion, and Rule 04B .0124, regarding potential for future measurement for meeting design standards for turbidity.
