Revised Riparian Buffer Rules, 401 Water Quality Certification Rules, and Isolated Wetlands and Isolated Waters Rules

Revised Riparian Buffer Rules have been adopted for the Goose Creek watershed, Catawba River Basin, Randleman Lake watershed, Neuse River Basin, and Tar-Pamlico River Basin.  Detailed information and a Fact Sheet with information regarding these revised rules can be found on the Division of Water Resources’ website at https://deq.nc.gov/about/divisions/water-resources/water-quality-permitting/401-buffer-permitting-branch/riparian.

 

The following 401 Water Quality Certification Rules and Discharges to Isolated Wetlands and Isolated Waters Rules have been recently revised and readopted:

  • 15A NCAC 02H .0506 - Review of Applications
  • 15A NCAC 02H .1301 - Scope and Purpose
  • 02H .1305 - Review of Applications
  • 02H .1306 - Soil Series 

These rules can be found at https://deq.nc.gov/about/divisions/water-resources/water-resources-regulations-guidance/401-buffer-permitting-statutes.

These rules have an effective date of June 15, 2020.

 

Some of the buffer rules have been relocated within the Administrative Code.  A Cross-Reference table of citations can be found on the website noted above.
