NOTIFICATION OF INTENT TO ISSUE A CONSENT ORDER

This is a Public Notice of intent to issue a State Consent Order to the following:

The City of Waynesville (16 S Main St, Waynesville, NC 28786) has requested Special Order by Consent S19-005 for its wastewater treatment facility under the authority of discharge permit NC0025321. The Waynesville WWTP discharges treated domestic wastewater to the Pigeon River in the French Broad River Basin.  The Environmental Management Commission proposes to issue the Order per Article 21 of Chapter 143, N.C. General Statutes, and other regulations effective January 1, 2021. Compliance with this Order requires the planning, design, and construction of improvements to the current WWTP, which include: Upgrade of the headworks, removal of primary clarifiers and replacement with primary drum filters, rehabilitation of the current aeration basins, installation of two new circular secondary clarifiers, improvements in solids management, conversion of the anaerobic digester to an aerated sludge holding tank and conversion from gas to liquid disinfection. Completion of the project will provide the Town with the ability to adequately treat incoming wastewater, properly manage solids, and aid the facility in returning to compliance with its NPDES permit.  Funding has been secured by Waynesville for the necessary construction activities. Waynesville shall comply with the NPDES permit limits with the exception of the interim limitations identified in the Order. Comments on the proposed Order received no later than December 1, 2020, will be considered in the final determination.
