NOTIFICATION OF INTENT TO ISSUE A CONSENT ORDER

 

Public notice of intent to issue a State Consent Order to the following:

 

The County of Chowan has requested Special Order by Consent EMC SOC WQ S16-003 Ad. II for operation of an existing wastewater treatment works in the Chowan River Basin under the authority of Permit NC0032719. The County is not discharging to said outlet according with NPDES Permit NC0032719, but rather into a settling basin (borrow pit) which is infiltrating into groundwater of the State. Chloride, Iron and Manganese have all exceeded the compliance boundary, so the County will need to prepare plans and specifications for construction and operation of additional treatment works and an alternative means of disposal.

The Environmental Management Commission proposes to issue the Order per Article 21 of Chapter 143, N.C. General Statutes, and other regulations.

 

Compliance with this order will require the County of Chowan to begin by submitting a preliminary Regionalization Study and Report in accordance to NCDEQ DWI/Merger/Regionalization Grant contract, submitting all plans and specifications, and completing construction to attain compliance with all permit conditions. This Order will expire on March 21, 2024.

Comments on the proposed Order received no later than 30 days from the date of publication will be considered in the final determination.
