Hazardous Waste Fees

Fee Schedule for Hazardous Waste Facilities (effective July 1, 2025)
N.C.G.S. 130A-294.1

North Carolina General Statute 130A-294.1 establishes fees applicable to generators and transporters of hazardous waste, and to hazardous waste storage, treatment and disposal facilities:

Hazardous Waste Activity Annual Fees*

  • Small Quantity Generator (SQG) $317
  • Large Quantity Generator (LQG) $1,660
  • Transporter $996
  • Treater $1,992
  • Storer $1,992
  • Disposer $1,992
  • Hazardous Waste Received – Commercial Facilities Only $2.45 tons
  • Hazardous Waste Generated $0.70/ton

* Effective July 1, 2025, the annual hazardous waste fees have been adjusted based on the Consumer Price Index (CPI) in accordance with North Carolina General Statute (N.C.G.S.) 143B-279.19For FY 2025-2026, DEQ increased applicable annual hazardous waste fees by 18.6% in accordance with N.C.G.S. 143B-279.19.  However, if a fee was previously increased as a result of S.L 2023-134 (e.g., the small quantity generator fee), the fee was only be increased by 5.6%, as recommended in the April 1, 2025, report to the General Assembly.  These percentages were based on calculations supported by the Office of State Budget and Management to reflect the CPI.   In all cases, the adjustment is rounded to the nearest dollar ($1.00).  A full list of the NCDEQ 2025 fees affected by the CPI adjustment can be found on the Department’s website at this link: https://www.deq.nc.gov/accessdeq/permit-fees-2025-updates

 

Permit Fees for Commercial Hazardous Waste Facilities

"Commercial hazardous waste facility" is defined at N.C.G.S. 130A-295.01(a)(1) and means any hazardous waste facility that accepts hazardous waste from off-site from the general public or from another person for a fee.  

  • "Person" is defined at N.C.G.S. 130A-290(a)(22) and means an individual, corporation, company, association, partnership, unit of local government, State agency, federal agency, or other legal entity.
Hazardous Waste Permit Application Fees (for Commercial Facilities)

An applicant for a permit for a hazardous waste storage, treatment, or disposal facility that proposes to operate as a commercial facility shall pay an application fee for each proposed activity as follows:

  • Storage Facility      $14,000
  • Treatment Facility  $ 21,000
  • Disposal Facility    $ 35,000  

 

Hazardous Waste Permit Modification Fees (for Commercial Facilities)

Hazardous waste permit modification fees are described in 15A NCAC 13A .0113(o). An applicant for a permit modification for a commercial hazardous waste facility shall pay an application fee for the Class of permit modification defined in 40 CFR 270.42 as follows: 

  • Class 1 permit modification $100
    • Class 1 permit modifications identified in Appendix I to 40 CFR 270.42 that do not require prior approval of the Division Director are excluded from the fee requirement.
  • Class 2 permit modification $1,000
  • Class 3 permit modification $5,000
