EPA's CAFO Rule and Lawsuit Status

EPA has proposed revisions to the CAFO Rule based upon the ruling by the 2nd-Circuit Court of Appeals in theWaterkeeper et al. v. EPA. The rules are avaialble for review by selecting the following link: Concentrated Animal Feeding Operations Proposed Rulemaking, June 2006. The new rules are scheduled to take effect on July 31, 2007.

In particular, the proposed rules address the "duty to apply" ruling by the Court by changing the requirement to those facilities that "discharge or propose to discharge" and the public notice responsibilities of the permitting authority to provide opportunity for public comment on each NPDES-permitted facility's nutrient management plan.

Performance Standards For New or Expanding Swine Farms
