NOTIFICATION OF INTENT TO ISSUE A CONSENT ORDER

Public notice of intent to issue a State Consent Order to the following:
The Town of Maysville (PO Box 265, Maysville, NC 28555) has requested Special Order by Consent EMC SOC WQ S22-002 for its Maysville WWTP, a 0.18 MGD WWTP that discharges treated wastewater to White Oak River in the White Oak River Basin under the authority of NPDES Permit NC0021482 but is unable to consistently comply with permit conditions and effluent limits for flow, Ammonia Nitrogen, Total Residual Chlorine, and Dissolved Oxygen.
The Environmental Management Commission proposes to issue the Order per Article 21 of Chapter 143, N.C. General Statutes, and other regulations effective January 1, 2023.
Compliance with this order will require the Town to prepare plans and specifications for construction and operation of additional treatment works, as well as an evaluation of their collection system to reduce infiltration and inflow to attain compliance with final effluent limits in Permit NC0021482. The Town shall comply with NPDES permit limits with the exception of the interim effluent limits identified in the Order. This Order will expire on May 1, 2027.

Comments on the proposed Order received no later than 30 days after the publish date of this notice will be considered in the final determination. A public meeting may be held if there is a significant degree of public interest.

Some of the parameters in the permit are water quality limited. This discharge may affect future allocations in this segment of Norris Branch. The N.C. Coastal Resources Commission (CRC) will meet Nov. 17 at the Beaufort Hotel, 2440 Lennoxville Road, Beaufort. The meeting will begin at 9 a.m., and a public input and comment period is scheduled for 1:30 p.m. At the chair’s discretion, comments may be limited to 3 minutes per person.

Prior to the commission meeting, the Coastal Resources Advisory Council (CRAC) will meet Nov. 16 at 3 p.m. at the same location. Both meetings are open to the public.

Currently, BOD, dissolved oxygen, fecal coliform, and ammonia nitrogen are water quality limited. This discharge may affect future allocations in this portion of the watershed. The N.C. Division of Coastal Management (DCM) announced today that the application period for local government planning and management grants for the 2022-2023 fiscal year has been extended. Local governments in the 20-county coastal area are invited to apply for funding for projects that are anticipated to begin Dec. 15 and to be completed by June 2023.
