This facility discharges to an unnamed tributary to Stewarts Creek in the Yadkin-Pee Dee River Basin. Currently, total residual chlorine (TRC), fecal coliform, and ammonia nitrogen are water quality limited. This permitted facility discharges treated industrial wastewater to the Rocky River which is classified C waters in sub-basin 03-07-11 of the Yadkin-Pee Dee River Basin. This permitted facility discharges treated municipal and industrial wastewater to Gunpowder Creek, a Class WS-IV water in the Catawba River Basin. Some of the parameters are water quality limited. The N.C. Coastal Resources Commission (CRC) will hold public hearings Jan. 9-Jan. 10, 2024, to receive comment on the following temporary rules: 07H .0507, .0508, .0509, 07I .0702, 07J .0203, .0204, .0206, .0207, .0208, 07M .0401, .0402, .0403, .0701, .0703, .0704 and .1101. Division of Coastal Management staff will facilitate the hearings, which will be held at the below dates and locations. All hearings will be held in-person and begin at 1 p.m., with registration beginning at 12:30 p.m.

PUBLIC NOTICE is hereby given that the North Carolina Department of Environmental Quality’s Division of Water Resources will hold a public hearing from 6 p.m. to 8 p.m. on February 5, 2024, for National Pollution Discharge Elimination System (NPDES) Wastewater Discharge Permit #NC0090247. The purpose of the hearing is to give the opportunity to comment on the draft NPDES permit.

Permit Application
Henderson County has applied for a new NPDES wastewater permit (NC0090247) for the Clear Creek Wastewater Treatment Plant, located near Fruitland Road, Hendersonville, NC, Henderson County. The facility will discharge treated municipal wastewater to Clear Creek in the French Broad River Basin (Class C). This discharge may affect future allocations in this portion of the French Broad River Basin. The location of the Outfall is: Latitude: 35° 22’ 32.1” N; Longitude: 82° 24’ 36.3” W.

A public hearing will be held on February 5, 2024, to accept public comments on the draft permit. Written comments will be accepted through February 6, 2024, at 5 p.m. All comments will be considered in the final determination regarding permit issuance and permit provisions.

The draft wastewater permit and related documents are available online at: https://deq.nc.gov/public-notices-hearings. Printed copies of the draft permit and related documents may be reviewed at the department’s Asheville Regional Office (2090 U.S. 70 Highway, Swannanoa, NC 28778-8211). To make an appointment to review the documents, please call 828-296-4500, and ask for a Water Quality Regional Operations Supervisor. File materials may not be removed from any DWR office; copy machines are available for use upon payment of the cost thereof to DWR pursuant to G.S. 132-6.2.

Public comments on the draft permit may be mailed to: Wastewater Permitting, Attn: Henderson County-Clear Creek WWTP Permit, 1617 Mail Service Center, Raleigh, N.C., 27699-1617, and must be postmarked no later than February 6, 2024. Public comments may also be submitted by email to: publiccomments@ncdenr.gov. Please include “Clear Creek WWTP” in the email subject line. Comments will be accepted via email until February 6, 2024, 5 p.m.

The N.C. Coastal Reserve and National Estuarine Research Reserve, a program of the Division of Coastal Management in the Department of Environmental Quality, hosted a stop on the “Discover the N.C. Coastal Reserve” Tour in early December. A guided walking tour of the Sunset Beach boardwalk and nature trail of the Reserve’s southernmost site, Bird Island Reserve, followed remarks by DEQ leadership, local, state and community leaders.
