Public Notice of Draft Renewal Permit

The Division of Energy, Mineral, and Land Resources (DEMLR) invites public comment on, or objections to, draft permits to be revised and re-issued. Persons wishing to comment on or object to the draft permit may submit comments to the contact person listed below during the public comment period. Current draft permits are listed below by permit type.

The Division of Energy, Mineral, and Land Resources (DEMLR) invites public comment on, or objections to, the following NPDES Stormwater Individual Permit to be issued. Persons wishing to comment on or object to the draft permit may submit comments to Brianna Young (Attn: DEMLR Stormwater Program) during the public comment period. Written comments may be submitted to the address at end of this message. 

All comments received through Dec. 1, 2024, will be considered in the final determinations regarding permit issuance and permit provisions. Public comments may result in changes to the proposed permitting actions.

The following facility has applied a new NPDES permit to discharge stormwater from their location:

  • Airgas USA, LLC [314 Lake Latham Road, Mebane, NC 27302] has requested renewal of permit NCS000598 for the Airgas USA, LLC facility in Alamance County. This facility discharges to an unnamed tributary to Moadams Creek (Latham Lake) in the Cape Fear River Basin.

All comments should reference permit number NCS000598.

The following facility has applied a new NPDES permit to discharge stormwater from their location:

  • American Distillation, Inc. [1690 Royster Road NE, Leland, NC 28451] has requested renewal of permit NCS000244 for American Distillation, Inc. - Navassa in Brunswick County. This facility discharges to an unnamed tributary to Cartwheel Branch in the Cape Fear River Basin.

  • Linde Gas & Equipment, Inc. [53 Frontage Road, Hampton, NJ 08827] has requested renewal of permit NCS000569 for Linde Gas & Equipment, Inc. in Durham County. This facility discharges to an unnamed tributary to Buck Branch in the Cape Fear River Basin.

  • Highline Warren, LLC [112 Maxfield Road, Greensboro, NC 27405] has requested new permit coverage assigned permit NCS000618 for Highline Warren, LLC in Guilford County. This facility discharges to an unnamed tributary to South Buffalo Creek in the Cape Fear River Basin.

All comments should reference permit number NCS000244, NCS000569, or NCS000618 (as appropriate).

  • Industrial and Agricultural Chemicals, Inc. [2042 Buie Philadelphus, Red Springs, NC 28377] has requested renewal of permit NCS000236 for the Industrial and Agricultural Chemicals, Inc. facility in Robeson County. This facility discharges to an unnamed tributary to Burnt Swamp in the Lumber River Basin.

All comments should reference permit number NCS000236.

  • Clear Path Recycling, LLC [3500 Cedar Creek Road, Fayetteville, NC 28312] has requested renewal of permit NCS000534 for the Clear Path Recycling, LLC facility in Cumberland County. This facility discharges to an unnamed tributary to the Cape Fear River in the Cape Fear River Basin.

  • Alpek Polyester USA, LLC [3216 Cedar Creek Road, Fayetteville, NC 28312] has requested renewal of permit NCS000534 for the Alpek Polyester USA, LLC Cedar Creek Site facility in Cumberland County. This facility discharges to an unnamed tributary to the Cape Fear River in the Cape Fear River Basin.

All comments should reference permit number NCS000389 or NCS000534 (as appropriate).

The Division of Energy, Mineral, and Land Resources (DEMLR) invites public comment on, or objections to, the following NPDES MS4 Stormwater Individual Permits and Stormwater Management Plans. Persons wishing to comment on or object to the draft permit may submit comments to Isaiah Reed (Attn: DEMLR Stormwater Program) during the public comment period. Written comments may be submitted to the address at end of this message. 

There are four sets of NPDES MS4 Stormwater Individual Permits and Stormwater Management Plans that are under public notice.  For the first set, the comment period ends June 9, 2024.    For the second set,  the comment period ends June 17, 2024.  For the third set, the comment period ends June 28, 2024.  For the fourth set, the comment period ends July 8, 2024.   All comments received by respective date will be considered in the final determinations regarding permit issuance and permit provisions.  Public comments may result in changes to the proposed permitting actions.

In the first set with period ending June 9, 2024, the following municipalities have applied for renewal of their NPDES permit to discharge stormwater:

Town of Hillsborough - Stormwater Management Plan and permit number NCS000466.

Town of Jamestown - Stormwater Management Plan and permit number NCS000400.

Town of Montreat - Stormwater Management Plan and permit number NCS000430.

City of Morganton - Stormwater Management Plan and permit number NCS000498.

Town of Mooresville - Stormwater Management Plan and permit number NCS000540.

City of Monroe - Stormwater Management Plan and permit number NCS000482.

City of Concord - Stormwater Management Plan and permit number NCS000423.

Town of Wake Forest - Stormwater Management Plan and permit number NCS000467.

Town of Harrisburg - Stormwater Management Plan and permit number NCS000513.

In the second set with period ending June 17, 2024, the following municipalities have applied for renewal of their NPDES permit to discharge stormwater:

City of Gastonia - Stormwater Management Plan and permit number NCS000429.

Town of Shelby - Stormwater Management Plan and permit number NCS000560.

In the third set with period ending June 28, 2024, the following entities have applied for renewal of their NPDES permit to discharge stormwater:

North Carolina State University - Stormwater Management Plan and permit number NCS000376.

Town of Graham - Stormwater Management Plan and permit number NCS000408.

In the fourth set with period ending July 8, 2024, the following entity has applied for renewal of their NPDES permit to discharge stormwater:

Town of Ayden - Stormwater Management Plan and permit number NCS000500.
